Information regarding our legal battle in Armenia – Update as of February 10, 2005

Dear Friends: Another day in court – another delay – another brick wall -- another example of ‘fraud’ within the system – we’re at a loss, but we won’t give up. We were not in court, but here is the account we have of what happened this morning in court.

The court was called to order at 11:00 am today. Three judges were presiding. They asked if Igityan was present. He presented himself fully prepared to testify, with a large suitcase by his side. One of the judges asked if anyone had any statement to make first. Our criminal attorney, Hrair rose and said something on the order of: “We have not filed a motion objecting to Igityan testifying here today, but we want the court to know that we object. Igityan has not been named as a defendant in this case; and, he is not a party to this appeal. Also, we have brought charges against him which could bring up to 8 years in jail. What is his standing in this court? This hearing is to hear the appeal by the Prosecutor General’s Office of the earlier decision of the Court of First Intention finding that these investigators have not performed their jobs properly. Igityan has nothing to do with this appeal.”

The judges responded something close to: “We were doing this to help you (meaning our attorneys)– so you could ask Igityan questions. You said you were denied the opportunity to ask him questions.” Hrair responded that Igityan’s answers in this setting have no validity; no one can determine if he is lying or telling the truth, he is not under oath, etc. – this is not a proper form in which to question him. He is not even named in the appeal.

The judges asked the two investigators if they had anything to say. The investigators said something like, “No – whatever the court decides is OK with us.” (This totally flabbergasted our attorneys – the appeal was brought by these investigators and they had nothing to say! They did not voice any objection.)

The judges took a full 5 minutes in front of the packed courtroom, huddled with each other in discussion as to what to do next. Then, they faced the court and said something like, “We agree – it is not proper to question Igityan here. Therefore, we will not question him. The case is postponed until Feb. 17.” Our attorneys objected! “What do you mean postponed? We are prepared to continue! This is highly unusual! Why is it postponed? ” The judges responded: It is postponed because we say it is postponed.

After the session, Igityan was approached by a number of journalists – but he ran away. Court TV was there – because Igityan called them three times and threatened to have their funding cut if they didn’t interview him. Therefore, they came to video his testimony in the court. They approached him asking him for an interview and to say whatever he wanted, but he started running…. “But you wanted us to interview you…..” Too late – he was gone as were the investigators who also refused to answer any questions as well.

Transparency? It depends on how one defines the term. Yes – the system is very ‘transparent’ – it is clear that the situation is being manipulated from another source. Whoever is behind this continues to ‘thumb his nose’ at us as he watches all of the puppets get tangled in their strings on the stage.
